(28-01-2009) Lieberman looks to Spain For an Example of how to treat Disloyalty

In an article for Walla News, Avigdor Lieberman looked toward the Spanish court's outlawing of the Batasuna party for its support of ETA as a positive example of what the Israeli Supreme Court should have done with Balad.  Here is an excerpt from Lieberman's article:

        When people have failed to contend with the facts and logical claims, the coping mechanism has been to resort to false accusations of discrimination based on race and that this is the path to Israel’s move to an apartheid state.  Israel Beytenu worked toward the banning of Balad not because it was the party of a minority group in Israel but rather because of its support of terror and its serving as its representative in the Knesset.

Against Terrorism – Not Against the Minority Population

In April 2003, a court announced the following verdict:
In light of the evidence and facts that have been presented to us, we have decided as follows:
1.    We declare the “Batasuna” party illegal
2.    We order the dismantling of this party
3.    We order the removal of the party from the list of registered parties
4.    The Batasuna party must cease all activities related to the party or otherwise
5.    All property belonging to the party will be confiscated
   This verdict was not given in a Muslim country, nor did it happen in a Latin American country.  This verdict was handed down in a European country, with a decidedly left-wing governmental coalition – Spain.
     When the Spanish Parliament petitioned the court to outlaw “Batasuna” for its support of terror, the court did not hesitate.  Unlike here, in Madrid no one fails to take seriously the issue of support for a terrorist organization.  This is the story of what happened in Spain.
     In August 2002, the Spanish Parliament approved a governmental proposal to take legal action to out law Batasuna for its failure to condemn the terrorist attacks carried out by the terrorist organization ETA.  The court ordered an injunction on all party activities.  A few months later, the court ruled that Batasuna was no longer a legal party.
    Despite the fact that Spain had not battled with terror to the degree that Israel had, its campaign against political support of terror did not end there.  In September 2007, the government arrested Batasuna’s political leaders for their open declarations in praise of terror.  In September 2008, the Spanish government decided to outlaw two more Basque parties: the “Communist Basque Party” and the “Nationalist Basque Party” on the grounds that they were mere fronts for Batasuna and ETA.  And as recently as a few days ago, the Spanish Police requested the court to outlaw two more Basque political parties because of their cooperation with Batasuna and support of ETA.

     In 2003, Israel’s Supreme Court allowed Balad to run in the elections on the grounds that insufficient proof had been presented to the effect that Balad rejects the existence of Israel as a Jewish state and supports an armed campaign against it. 
     However, since then many Arab Members of Knesset have broken all limits.  The founder and Balad and its spiritual leader until today, Azmi Bashara fled the country after is became known that he advised Hezbollah on targets in northern Israel during the Second Lebanon War.  His political heir, Jamal Zahalka, has praised the arch-murderer George Habash and has openly declared, “We at Balad maintain an historical opposition to the character of the State and its essential definition as a Jewish state.” 
     In September 2002, Professor Ruth Gavison said, “I do not expect any Arab to be a Zionist and be content with the fact that this is a Jewish State. I also understand Arab leaders who do not wish to give legitimacy to this entire venture.  But in that case, he may not sit in the Knesset.  .  . This is the Knesset of the Jewish State.”  With their decision, the judges of the Supreme Court permitted the Arab Members of Knesset to continue to grind down the foundations of the Jewish State from within the Knesset and by its appointment. 
    We have judges in Jerusalem; however, it seems that they do not understand that which their colleagues in Spain do understand.   For their benefit, let’s review what their previous president Aharon Barak said, “Democracy does not have to kill itself to prove it is alive.”
